Purpose

This Messaging Opt-In and Opt-Out Policy (“Policy”) describes how The FSD Group LLC, a North Carolina limited liability company doing business as Ciclo (“Company,” “Ciclo,” “we,” “us,” or “our”), obtains, documents, manages, and processes consent for SMS, MMS, Rich Communication Services (“RCS”), email, and other communications transmitted through or related to Ciclo’s Platform and services.

This Policy is intended to promote transparency, ensure compliance with applicable laws and industry standards, and provide users with clear information regarding their communication preferences and rights.

Applicability

This Policy applies to all individuals, businesses, clients, customers, users, and other persons who provide contact information to Ciclo or otherwise interact with Ciclo’s Platform, website, products, services, or communications channels.

By submitting contact information, registering for an account, using Ciclo’s services, or otherwise consenting to communications, users acknowledge and agree to the practices described in this Policy.

Methods of Consent Collection

Ciclo obtains consent through various methods, including but not limited to:

Account registration and onboarding processes
Contact Sales submissions
Learn More forms and other website forms
Service enrollment processes
Customer support interactions
Other written, electronic, or digital consent mechanisms made available by Ciclo

Users may be required to provide business information, contact information, and communication preferences as part of these processes.

Explicit Consent Requirements

Ciclo utilizes an express opt-in model for marketing and promotional communications.

Prior to receiving marketing, promotional, or non-essential communications, users must affirmatively consent by actively selecting an unchecked consent box or otherwise providing legally sufficient consent.

Consent language presented to users may include statements substantially similar to the following:

"I agree to receive SMS, RCS, and email communications from Ciclo related to account notifications, campaign updates, service communications, and promotional marketing. Message frequency may vary. Message and data rates may apply. Reply STOP to unsubscribe at any time. Reply HELP for assistance."

Consent is never inferred, automatically granted, or obtained through pre-selected checkboxes.

Users must take an affirmative action to indicate consent.

Legal Agreement Acknowledgment

As part of account registration, onboarding, or service enrollment, users may be required to acknowledge and accept Ciclo's legal agreements, including but not limited to:

Terms of Service
Privacy Policy
Acceptable Use Policy
Other applicable agreements or disclosures

Acceptance of such agreements does not independently constitute consent for marketing communications where separate consent is legally required.

Consent Documentation and Record Retention

Ciclo maintains records evidencing consent for compliance, operational, and legal purposes.

Such records may include, without limitation:

User name
Business name
Email address
Telephone number
Date and time of consent
IP address
Source of consent
Consent language displayed at the time of collection
Consent status
Accepted agreements and acknowledgments

Consent records are retained in accordance with applicable legal requirements, internal retention policies, and operational needs.

Users who have provided consent may receive communications including, but not limited to:

SMS, MMS, and RCS Communications

Account notifications
Campaign updates
Service announcements
Technical support communications
Billing notifications
Product updates
Promotional messages
Marketing communications

Email Communications

Campaign reports
Billing communications
Product announcements
Service notifications
Promotional offers
Marketing communications

Message frequency may vary depending upon account activity, service usage, campaign activity, and user preferences.

Opt-Out and Revocation of Consent

Users may revoke consent or opt out of marketing communications at any time through any of the following methods:

Replying "STOP" to SMS, MMS, or RCS messages
Replying "HELP" for assistance
Clicking the unsubscribe link contained in marketing emails
Updating communication preferences within account settings, where available
Contacting Ciclo customer support

Ciclo will process opt-out requests as promptly as reasonably practicable.

Following an opt-out request, users will no longer receive marketing or promotional communications unless additional consent is subsequently provided.

Users acknowledge that essential operational communications, including account, billing, security, transactional, legal, or service-related notifications, may continue where necessary to provide services, maintain account integrity, comply with legal obligations, or protect the Platform.

Ciclo's messaging practices are intended to comply with applicable laws, regulations, and industry standards, including, without limitation:

Telephone Consumer Protection Act (TCPA)
CAN-SPAM Act
Federal Communications Commission (FCC) regulations
Federal Trade Commission (FTC) regulations
CTIA Messaging Principles and Best Practices
Google RCS Business Messaging policies
Applicable federal, state, and local privacy laws
Modifications to This Policy

Ciclo reserves the right to modify, amend, or update this Policy at any time to reflect changes in legal requirements, industry standards, business practices, or operational needs.

Updated versions will be posted with a revised effective date. Continued use of Ciclo's services following publication of an updated Policy constitutes acknowledgment of the revised Policy.
